California's law on sexual assault (also referred to as sexual battery) is different from statutes concerning rape in that it does not involve sexual intercourse. Rather, a person commits the offense of sexual assault when they touch, or make physical contact with, the intimate parts of another person.

According to California Penal Code 243.4 PC, intimate parts include:

  • Sexual organs,
  • Anus,
  • Groin,
  • Buttocks, and
  • Breasts (of females only)

What Acts Are Prohibited Under the Law?

California's law concerning sexual assault criminalizes various types of conduct.

It is illegal for a person to touch the intimate parts of another when they are:

  • Unlawfully restrained
  • Institutionalized for medical treatment
  • Unconscious to the actual reason for the touching

Furthermore, a person could be accused of committing sexual assault if they make someone masturbate or touch the intimate parts of someone else.

What Are the Penalties for Sexual Assault?

In California, sexual assault is a wobbler offense, which means it can be charged as a misdemeanor or felony.

  • Felony: 2, 3, or 4 years in prison and/or up to $2,000 in fines
