Can I Go to Jail as a First-Time Offender?

Yes. Even first-time offenders can face jail time if the crime is severe enough. Some examples include aggravated DUI, serious sex crimes, and serious felony charges. What Crimes Can Be Expunged in California?

Expungement is a process that removes eligible records from public view, resulting in a “fresh start” for qualifying defendants. This does not change the verdict of your case, but seals your criminal record in accordance with state law. 

While many felony and misdemeanor offenses can be expunged, violent and serious felonies are generally ineligible. Individuals who are registered sex offenders or currently on parole are ineligible for expungement.

What Happens After an Arrest?

After an arrest, the criminal process generally involves the following stages:

Booking

Law enforcement collects fingerprints and personal information. 

Arraignment

The defendant hears the formal charges against them and is asked to enter a plea.

Pretrial Activities

Both sides may file pretrial motions to suppress evidence, compel discovery, or dismiss the case. Plea deals may also be offered at this stage.

Preliminary Hearing

In felony cases, a preliminary hearing is held to determine whether there is sufficient evidence to proceed to trial. 

Trial 

If an agreement is not reached, the case proceeds to trial, where it will be held before a judge (bench trial) or jury (jury trial).

Verdict

The judge or jury issues a verdict of guilty or not guilty. 

Sentencing

If the defendant is found guilty, the judge will issue a sentence.

Appeal

The defendant has the right to appeal or file post-conviction motions.
