Drug Manufacturing Defense Lawyer in Orange County
Accused of Drug Manufacturing in Orange County? Get Decades of Experience Defending Serious Charges
A drug manufacturing allegation can reach beyond the person accused of operating equipment or completing a chemical process. Investigators may focus on who obtained supplies, controlled a property, exchanged digital messages, handled chemicals, or participated in an alleged production operation. Unlike a simple possession charge, these cases often turn on technical evidence and the accused person’s precise role.
At The Law Offices of Jacqueline Goodman, we defend people facing serious criminal charges throughout California. Led by an attorney with State Bar certification in criminal law, we examine the alleged conduct, how investigators collected the evidence, whether a search was lawful, and whether the facts connect you to manufacturing activity.
Call (657) 571-2266 to request a confidential evaluation of an investigation, search, arrest, or criminal charge. Our drug manufacturing defense attorney in Orange County, CA, can fight for you.
What California Health & Safety Code Section 11379.6 Covers
California Health and Safety Code section 11379.6 addresses manufacturing, compounding, converting, producing, deriving, processing, or preparing specified controlled substances through chemical extraction or chemical synthesis. Chemical extraction separates a substance from other material, while chemical synthesis creates one through chemical reactions.
The alleged stage of the process matters. Buying supplies, being present at a location, or associating with another accused person isn’t automatically the same as entering the manufacturing process. We examine what allegedly occurred, when and where it happened, and whether the evidence establishes the required knowledge or intent. Those details can determine whether the allegations involve completed manufacturing, an attempt, or conduct that remained preliminary.
Potential Penalties & Sentencing Factors
Section 11379.6 currently provides a sentencing range of three, five, or seven years of imprisonment and a fine of up to $50,000 for the covered offense. The statute also identifies certain circumstances involving children and the proximity of manufacturing activity to occupied residences or other structures as potential sentencing factors. Separate statutory enhancements may apply in specified circumstances, including when a child under 16 is present during certain methamphetamine or phencyclidine manufacturing offenses
Possible consequences depend on the charge, underlying facts, prior record, and any additional offenses or enhancements. The statutory maximum doesn’t predict the outcome of an individual case, and California law can change. A case-specific review is necessary to assess potential exposure and defense options.
How We Review Evidence in Manufacturing Cases
Our review begins with the prosecution’s theory and the evidence offered to support it. If someone is under investigation but hasn’t been charged, we also provide pre-file investigation services and seek early intervention when appropriate.
Key areas of review can include:
Search and seizure: We examine the legal basis for a search, the support for any warrant, how officers executed it, and whether the seized evidence can be used.
Forensic evidence: Chemical testing, laboratory methods, photographs, and collection records may require separate analysis.
Chain of custody: This record tracks who collected, stored, transferred, and tested an item from its seizure through court.
Knowledge and participation: Text messages, financial records, witness accounts, ownership records, and location evidence can affect how the prosecution characterizes each person’s role.
Presence at a property, ownership of a vehicle, or knowledge of another person’s conduct doesn’t establish participation by itself. We compare each piece of evidence with the alleged process and timeline rather than assuming everyone connected to a location played the same role.
