Our very own Attorney Goodman was recently asked to comment on My News LA's investigation of Senate Bills 421, 10, and 620. Despite the opposition from District Attorney Tony Rackauckas, who states this new legislation will result in catastrophic consequences, Attorney Goodman disagrees.

Senate Bill 421 would alter Megan's Law into a tiered system, which would allow some sex offenders the opportunity to refrain from registering with law enforcement after 10-20 years of their initial crime. Senate Bill 10 would make bail more affordable, and Senate Bill 620 would remove the requirements of state-mandated sentencing enhancements for gun violence.

Attorney Goodman stated, "The bill allows the court to have that discretion instead of putting it solely in the hands of a DA's decision whether to include the enhancement"--which will encourage many defendants to plead guilty rather than to risk receiving a life sentence. She believes the new legislature would make the bail system far fairer for defendants of a lesser means, which will, in turn, encourage provisions that guard against the release of the most dangerous criminals.

Goodman also believes SB421 brings more weight back to certain systems, such as the sex offender registration system. Because so many people are registered as sex offenders, it no longer serves as a useful tool due to the oversaturation. As a result, a misdemeanor sex offender would register for a minimum of 10 years, and then petition for removal through the courts. Therefore, the accused would be more likely to reform his or her ways.
