UNDERSTANDING FELONY DUI CHARGES IN CALIFORNIA

In the state of California, no person is allowed to operate a motor vehicle while under the influence of drugs/alcohol, that is to say, with a blood alcohol concentration (BAC) of .08 percent or higher. Doing so may result in criminal DUI charges, which are typically prosecuted as misdemeanors with appropriate misdemeanor penalties.

In some cases, however, a DUI will be charged as a felony. As a result, a conviction will come with much harsher penalties than a conviction for a typical DUI.

In California, DUI is considered a felony when the following factors are present:

  • The alleged offender has a previous conviction for felony DUI
  • The alleged offender has been convicted of DUI more than two times in a period of 10 years
  • The alleged offender caused an accident while driving under the influence of drugs/alcohol, and that accident resulted in the severe injury or death of another person
